Terms of Service

1. Acceptance of Terms

These Terms of Service ("Terms") govern your use of vehicle rental services provided by Essential Car Rentals ("Company", "we", "us", or "our"). By making a reservation or renting a vehicle from us, you agree to be bound by these Terms.

Please read these Terms carefully before making a reservation. If you do not agree with any part of these Terms, you may not use our services.

2. Rental Requirements

2.1 Age Requirements

  • Minimum age: 21 years for standard vehicles
  • Minimum age: 25 years for premium, luxury, and specialty vehicles
  • Young driver surcharge may apply for renters aged 21-24
  • Maximum age restrictions may apply (typically 70-75 years)

2.2 Driver's License Requirements

  • Valid driver's license held for at least 1-2 years (varies by vehicle category)
  • International Driving Permit (IDP) required for non-EU/EEA licenses
  • License must be valid for the entire rental period
  • Digital/electronic licenses may not be accepted

2.3 Required Documents

  • Original driver's license (copies not accepted)
  • Valid passport or national ID card
  • Credit card in the main driver's name for deposit
  • Proof of address may be required

3. Reservations and Booking

3.1 Making a Reservation

Reservations can be made through our website, mobile app, or by contacting us directly. A reservation is confirmed only after you receive a confirmation email with a booking reference number.

3.2 Vehicle Availability

We reserve the right to provide a vehicle from a similar or higher category if the reserved vehicle is unavailable. We will notify you of any changes as soon as possible.

3.3 Modifications

Reservation modifications are subject to availability and may result in price changes. Please contact us at least 24 hours before pickup to request modifications.

4. Payment Terms

4.1 Rental Charges

The total rental cost includes:

  • Base rental rate for the selected period
  • Applicable taxes and fees
  • Optional extras (GPS, child seats, additional drivers, etc.)
  • Insurance coverage selected

4.2 Security Deposit

A security deposit is required at pickup and will be blocked on your credit card. The deposit amount varies by vehicle category and insurance coverage selected. The deposit will be released within 7-14 business days after return, subject to vehicle inspection.

4.3 Payment Methods

We accept major credit cards (Visa, MasterCard, American Express). Debit cards may be accepted with additional verification. Cash payments are generally not accepted for the security deposit.

4.4 Additional Charges

You may be charged additional fees for:

  • Late returns (charged per hour or day)
  • Fuel not replaced to pickup level
  • Excessive mileage beyond included kilometers
  • Cleaning fee for excessively dirty vehicles
  • Traffic fines and toll charges
  • One-way rental fees
  • Cross-border travel fees (if permitted)

5. Vehicle Use and Restrictions

5.1 Permitted Use

The vehicle may only be driven by authorized drivers listed in the rental agreement. The vehicle must be used solely for personal transportation purposes.

5.2 Prohibited Use

The following uses are strictly prohibited and will void all insurance coverage:

  • Driving under the influence of alcohol, drugs, or medications affecting driving ability
  • Reckless driving, racing, or speed competitions
  • Off-road driving or on unpaved roads (unless vehicle is specifically designed for such use)
  • Towing or pushing other vehicles
  • Transporting more passengers than seatbelts available
  • Commercial use (taxi, ride-sharing, delivery services)
  • Transporting hazardous materials
  • Allowing unauthorized persons to drive
  • Leaving the vehicle unlocked or keys inside
  • Smoking in the vehicle
  • Transporting pets without prior approval and protective covers

5.3 Geographic Restrictions

Cross-border travel may be restricted or require prior written approval and additional fees. Some countries may be completely prohibited. Please inquire about specific restrictions before your trip.

6. Insurance and Liability

6.1 Basic Coverage

All rentals include basic third-party liability insurance as required by law. This covers damages caused to other people and their property, subject to policy limits.

6.2 Collision Damage Waiver (CDW)

CDW reduces your financial responsibility for damage to the rental vehicle. Even with CDW, an excess (deductible) amount applies. You can purchase additional coverage to reduce or eliminate the excess.

6.3 Theft Protection (TP)

Theft Protection limits your liability if the vehicle is stolen. An excess amount still applies unless you purchase full theft waiver coverage.

6.4 What's Not Covered

Standard coverage typically excludes:

  • Damage to tires, wheels, undercarriage, roof, and interior
  • Loss of personal belongings
  • Damage caused by prohibited use
  • Damage from driving on unsuitable roads
  • Misfueling (wrong fuel type)
  • Key loss or lockout

6.5 Your Liability

You are financially responsible for any damage or loss not covered by insurance, up to the full value of the vehicle. This includes damage caused by negligence or violation of rental terms.

7. Fuel Policy

Our standard fuel policy is "Full-to-Full": you receive the vehicle with a full tank and must return it with a full tank. Alternative policies may be available:

  • Full-to-Full: Return with full tank or pay refueling fee plus service charge
  • Prepaid Fuel: Pay for full tank upfront, return at any level (no refund for unused fuel)

Using incorrect fuel type will result in full liability for any resulting damage.

8. Vehicle Pickup and Return

8.1 Pickup

  • Arrive at least 15 minutes before your scheduled pickup time
  • Bring all required documents (license, ID, credit card)
  • Inspect the vehicle carefully and note any existing damage
  • Sign the rental agreement and vehicle condition report

8.2 Return

  • Return the vehicle on time to the agreed location
  • Remove all personal belongings
  • Return all accessories, documents, and keys
  • Participate in the return inspection

8.3 Late Returns

Late returns may be charged at hourly rates (typically up to 3 hours grace period) or an additional day rate. Significant delays without notice may be treated as theft.

8.4 Out-of-Hours Service

Pickup or return outside normal business hours may incur additional fees and must be arranged in advance.

9. Cancellation Policy

  • Free cancellation: More than 48 hours before pickup
  • 24-48 hours before pickup: 50% of prepaid amount may be retained
  • Less than 24 hours or no-show: Full prepaid amount may be retained

Refunds will be processed within 7-14 business days to the original payment method. Promotional rates may have different cancellation terms.

10. Accidents and Emergencies

In case of an accident, theft, or breakdown:

  1. Ensure safety of all persons involved
  2. Call emergency services if needed (112 in EU)
  3. Do not admit fault or liability
  4. Collect information from other parties (names, contact details, insurance, vehicle registration)
  5. Take photos of the scene and damage
  6. File a police report (required for insurance claims)
  7. Contact us immediately at info@ecrentals.co.nz
  8. Complete an accident report form within 24 hours

Failure to report an accident may void insurance coverage and result in full liability for damages.

11. Traffic Violations and Fines

You are responsible for all traffic violations and fines incurred during the rental period, including:

  • Speeding tickets
  • Parking violations
  • Toll evasion
  • Red light violations
  • Low emission zone violations

An administrative fee will be charged for processing each violation notice. We are legally required to provide your details to authorities upon request.

12. Damage Assessment and Charges

Upon return, the vehicle will be inspected for damage. You will be charged for:

  • Repair costs for any new damage (up to insurance excess)
  • Loss of use during repairs
  • Diminished value if applicable
  • Administrative fees

We use standardized damage assessment guidelines. You have the right to dispute charges within 14 days of receiving the damage invoice.

13. Personal Data

Your personal data is processed in accordance with our Privacy Policy. By agreeing to these Terms, you acknowledge that you have read and understood our privacy practices.

14. Limitation of Liability

To the maximum extent permitted by law:

  • We are not liable for indirect, incidental, or consequential damages
  • We are not responsible for loss or damage to personal property left in vehicles
  • Our total liability is limited to the rental charges paid
  • We are not liable for delays or failures due to circumstances beyond our control

15. Governing Law and Disputes

These Terms are governed by the laws of the country where the rental takes place. Any disputes shall be resolved through:

  1. Direct negotiation between the parties
  2. Mediation through an accredited mediation service
  3. Courts of the jurisdiction where the rental location is situated

16. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting to our website. The Terms in effect at the time of your booking will apply to your rental.
